1. Who processes your data

2. What we collect, and what for
We only process the data you hand us through one of the site's two forms, and only for the purpose it was collected for.
Contact form
First name, last name, email address and the content of your enquiry.
Purpose: to read your enquiry and reply to it. We do not use this data to send you marketing.
Complaints Book
Name and surnames, identity document type and number, home address, email, mobile number, the description of the goods or service and the amount claimed, the details of your claim and what you are asking for; and, where the consumer is a minor, the name of the parent or legal representative.
Purpose: to file, handle and answer your claim, and to keep the record the Complaints Book requires.
Technical data about the submission
Submitting either form records the date and time, the IP address it was sent from, and the version of this notice that was on screen. The IP address is not kept in the clear: it is stored encrypted with a cryptographic salt, so it is not legible in our records.
Purpose: to prevent automated abuse of the forms, and to be able to evidence when you gave your consent and what you were told at the time.
3. The basis for processing it
Your consent, given by ticking the box on the form before sending it: freely given, prior, express, informed and unambiguous. You may withdraw it at any time by writing to us, without affecting processing already carried out.
For the Complaints Book, beyond your consent, keeping the record is a legal obligation of ours: Supreme Decree 011-2011-PCM requires us to maintain it and to retain what is filed in it.
The fields marked as required are the minimum needed to handle your request: without them we cannot reply to you or, for a claim, file it.
4. How long we keep it
- Contact form enquiries: one (1) year from your last message.
- Claims: two (2) years from filing, the minimum required by Supreme Decree 011-2011-PCM.
Once the period is over we delete it, unless a legal rule or an ongoing proceeding requires us to keep it longer.
5. Who we share it with
We do not sell or transfer your personal data to third parties for commercial purposes. It is accessed only by the staff who handle enquiries and claims, and by the providers that run the site's hosting, the service that receives the forms and email delivery, all acting on our behalf and on our instructions.
Those providers may store the information on servers located outside Peru, which is a cross-border flow of personal data (article 15 of Law 29733). By accepting this policy you consent to that flow, which we carry out with providers that maintain adequate levels of protection.
We also hand over the information when a competent authority requires it by law — for example Indecopi, in relation to a claim.
6. Your rights
Over the data you gave us you may exercise, at any time and free of charge, your rights of:
- Access: to know what data of yours we hold and how we process it.
- Rectification: to correct data that is inaccurate or incomplete.
- Cancellation or erasure: to have it deleted once it is no longer needed for the purpose it was collected for, or once you withdraw your consent.
- Objection: to object to a specific processing activity where you have legitimate grounds.
- Portability: to receive the data you gave us in a commonly used format, or to have us hand it to another controller where technically possible.
The regulation in force also recognises further rights, such as de-indexing and objecting to automated decisions. You may exercise them the same way, though this site takes no automated decisions about you.
To exercise them, write to contacto@smoagroup.com stating which right you wish to exercise and attaching a copy of your identity document. We answer within the deadlines set by the regulation: twenty (20) working days for access, ten (10) working days for the rest, counted from the day after your request.
If you believe we did not handle your request properly, you may complain to the National Authority for the Protection of Personal Data at Peru's Ministry of Justice and Human Rights.
7. Data concerning minors
This site is not aimed at minors and we do not knowingly collect their data. The one exception is the Complaints Book, where the law allows the consumer to be a minor: in that case we ask for the name of the parent or legal representative, and we understand that person to be the one filing the form. If we notice a minor's data collected without that authorisation, we delete it.
8. Cookies and third-party services
This site sets no cookies of its own and uses no analytics or advertising tools to track your browsing.
It does display content served by third parties: the Google Maps map in the footer and images hosted with our content provider. Loading them gives those third parties your IP address and lets them set their own cookies, under their own policies. The cargo tracking link leads to a third-party platform with its own terms.
9. Security
The site is served over HTTPS and access to what you submit through the forms is restricted to the staff who need to handle it. No measure is infallible, but we maintain those reasonable for the kind and volume of data we process.
10. Changes to this policy
If we change this policy we will publish the new version on this same page, with its effective date. Every form submission stores the version of the notice that was on screen, so there is a record of what you were told when you gave your consent.
